Challenging the Results of Chemical Testing

There are several defense strategies that your San Diego DWI lawyer may utilize depending on the facts of your case. 
One cause for challenging chemical test results can stem from the arresting officer not following standard procedure while administering a test, resulting in inaccurate results.
Additionally, results can be found to be inaccurate due to mechanical breakdown or human error. Faulty equipment, incorrect calibration or mechanical breakdown could cause incorrect blood alcohol content results.

Breathalyzer Inaccuracies

Other factors, such as the presence of “mouth alcohol” could lead to an erroneous blood alcohol breathalyzer reading. Mouth alcohol refers to alcohol still present in an individual’s mouth that can significantly elevate BAC reading. Mouth alcohol can occur for a number of reasons, including alcohol trapped beneath dental work, recent vomiting or burping, or as a result of acid reflux. Because breathalyzer machines measure air from the lungs, there is a multiplication formula which is applied to determine blood alcohol level. Any mouth alcohol will be subjected to this exponential increase and can therefore register inaccurate blood alcohol content levels over the legal limit.
